PROBLEM TO BE SOLVED: To provide a heat insulating structure capable of being easily constructed, and a building using it. SOLUTION: In this heat insulating structure 5 which comprises at least a frame body 6, a vacuum heat insulating material 2 and a mounting member 7, the mounting member 7 is positioned between the frame body 6 and the heat insulating material 2, and at least a part of a peripheral part 9 of the heat insulating material 2 is held in a sandwiched state by the deformation of the mounting member 7, so that the heat insulating material 2 can be arranged between the frame bodies 6. When the heat insulating material 2 is arranged between the frames 6, a variation in dimension between the frame bodies 6 can be absorbed because the mounting member 7 is deformed. This facilitates the construction of the heat insulating structure 5. Since a gap between the frame body 6 and the heat insulating material 2 is filled with the mounting member 7, a hollow part of the heat insulating structure 5 is reduced so as to enhance the heat insulating effect of the heat insulating structure 5.
