PROBLEM TO BE SOLVED: To provide a vehicle control device and a vehicle control method capable of controlling a vehicle by accurately sensing mis-stepping of a brake pedal. SOLUTION: The vehicle control device to control the vehicle by sensing mis-stepping of the brake pedal 11 of the vehicle is equipped with an offset sensing means 10 to sense the stepping position Q on the brake pedal 11, a brake pedal stroke sensor 12 to sense the stroke of the brake pedal 11, a control part 15 to judge mis-operation of the brake pedal 11 on the basis of the stepping position on the brake pedal 11 and the stroke of the brake pedal 11, and controlling means 16 and 17 to control the braking force of the vehicle or its engine if judgement passed is such that the brake pedal 11 is mis-operated.
