PROBLEM TO BE SOLVED: To provide an emulsion composition that is prepared by emulsifying a variety of oily components into fine and stable particles in no need of activator. SOLUTION: This oil-in-water type emulsion composition comprises (A) a non-crosslinked cationic polymer including a cationic polymerization unit represented by general formula (1) and a hydrophobic polymerization unit represented by general formula (2) as constitution units, (B) oily component, (C) water and (D) a water-soluble organic solvent wherein the content of (A) component is 1/50 to 5 time weight of (B) component and the volume average particle size of the emulsion particle is 0.01 to 0.3μm. [wherein R<SP>1</SP>, R<SP>2</SP>, R<SP>3</SP>, R<SP>4</SP>, R<SP>5</SP>and R<SP>6</SP>are each H or a 1 to 2C alkyl; R<SP>7</SP>is a 1 to 30C alkyl or alkenyl; X<SP>1</SP>and X<SP>2</SP>are each O, NH; Y<SP>1</SP>is a 1 to 8C akylene; Z is a part or the total of an amino group represented by -N(R<SP>8</SP>)R<SP>9</SP>(wherein R<SP>8</SP>and R<SP>9</SP>are each H or a 1 to 4C alkyl) or its acid salt or quaternary ammonium salt].
