PROBLEM TO BE SOLVED: To provide a data communication apparatus and a data communication method in which retransmission control can be carried out with a number of times of retransmission dependent on the real time level or the reliability level of transmission data. SOLUTION: In the data communication apparatus, a number of times of retransmission is set depending on the protocol of a transport layer and when a response signal from the communication partner is not received within a predetermined time, a retransmission control means determines the protocol of the transport layer based on the header information of a packet transmitted and performs retransmission control based on the determination results and the set value of the number of times of retransmission.
