PROBLEM TO BE SOLVED: To provide a mobile communication system and a mobile terminal which can suppress degradation in transmission quality, by allowing a base station, to which interference amount exceeds a permissible amount, to control the transmission power of data transmitted from the mobile terminal. SOLUTION: A base station control apparatus 3 is constituted so as to allot a plurality of base stations 2 into a base station of E-DCH active set or the base station of an active set for soft handover (conventional active set), in accordance with the data reception condition at the plurality of base stations 2.
