A device and a method for avoiding SLA violation of communication quality are provided to avoid the communication quality SLA violation of a subscriber by analyzing an SLA violation ratio based on performance information measured and collected in the network, and adjusting a priority of processing data of the subscriber according to an analysis result. An SLA manager(400) generates SLA determination information and determines the user to violate the SLA by comparing data transfer performance information between a subscriber and server terminal(100,200) with SLA information of each subscriber. A network configuration manager(500) generates a configuration command to avoid the SLA violation by compares the SLA determination information with network configuration information of each subscriber. A data transmitter(300) periodically collects/provides the performance information to the SLA manager, changes the data transfer priority of each subscriber by the configuration command, and performs data transfer between the subscriber and server terminal according to the changed priority.
