A disc discrimination method of an optical recording and reproducing apparatus is provided to insert a disc into a tray of the optical recording and reproducing apparatus and more shorten a disc discrimination time until the disc is discriminated after a tray close command is ordered. A control unit opens a tray in which a disc is mounted(S100,S101). The control unit conveys an optical pickup to a disc discrimination position while the opened tray is closed. After the opened tray starts close operation, the control unit conveys the optical pickup after a predetermined time elapses(S102-S105). After the conveyance of the optical pickup is completed(S106), the control unit irradiates a beam through the optical pickup and discriminates a kind of the disc(S107).
