PROBLEM TO BE SOLVED: To maximize energy by reducing loss by constructing a signal more matching with a source signal or to decrease the number of bits of side-wave information, and further to improve the sound quality. SOLUTION: This is a phase detecting method of detecting a phase for intensity stereo (I/S) in audio encoding or the like, and it determines a start scale factor band to which I/S is applied; determines the whole band to which I/S is applied; finds the spectrum total S of left and right spectra L and R; calculates the energy Es of the spectrum total S as to each band; finds the spectrum difference D between the left and right spectra L and R as to each band; calculates the energy Ed of the spectrum difference D as to each band; compares the levels of the energies Es and Ed; and (g) determines the initial phase of the band.
