An apparatus and a method for executing garbage collection of a nonvolatile memory according to power state are provided to use power of a portable device more efficiently, by controlling the magnitude of garbage collection cost and operation period on the basis of the power state of the portable device. A nonvolatile memory(300) stores data. A power state check part(230) checks power state of a portable device comprising the nonvolatile memory. A garbage collection unit(220) collects a physical block allocated to the nonvolatile memory on the basis of the checked power state. A block allocation part(210) allocates the physical block to the nonvolatile memory. A list storing part(240) stores an allocated block list for the physical block allocated in the nonvolatile memory and a free block list for an empty physical block.
