PROBLEM TO BE SOLVED: To provide a data detecting apparatus and a method capable of highly precisely acquiring living body data in non-contact with and non-invasively to the living body. SOLUTION: This data detecting apparatus 1 is provided with an image capturing section 6 capturing a thermal imagery near the nostrils or the nasal cavity of the living body, and a data processing section 7 detecting the body temperature of the living body by converting pixel values of the thermal imagery captured by the image capturing section 6 into temperature data. The image capturing section 6 captures a moving image and the data processing section 7 detects the body temperature of the living body from the maximum value of the time-series variations of the temperature data corresponding to the pixel values of the moving image and detects the respiration state of the living body.
