PROBLEM TO BE SOLVED: To obtain large modulation at a transmission wavelength in a simple and fine configuration by using a photonic crystal. SOLUTION: An optical element 10 comprises an optical waveguide 1 made of a piezoelectric material, a photonic crystal structure 2 disposed in the waveguide 1, a pair of control electrodes 3, 4 formed holding the upper and lower faces of the optical waveguide 1 and applying a voltage to the waveguide 1, and a support 5 disposed at both ends of the lower control electrode 4.
