PROBLEM TO BE SOLVED: To perform efficient encoding by appropriately selecting either a time direct mode or a space direct mode for a direct mode.

SOLUTION: A space direct/time direct determination section 160 determines temporal functionality of an image to be encoded and if the temporal functionality is low, a space direct mode is selected. Furthermore, the space direct/time direct determination section 160 adds a fixed value to an information quantity required for encoding in the space direct mode and provides a value greater than real one so as to hardly select the direct mode in a motion vector/direct determination section 180 if the space direct mode is selected.
