PROBLEM TO BE SOLVED: To provide a recording and reproducing device capable of increasing the availability of a recording medium without lowering the sound quality or image quality of sound or video data to be recorded newly. SOLUTION: The recording and reproducing device having the recording medium 7a for recording the sound or video data and a recording and reproducing part 7 for reproducing the data recorded by the recording medium 7a is provided with: a capacity detection means for detecting the capacity of the recording medium 7a; a decision means for deciding whether or not the availability of the recording medium 7a is a prescribed capacity or more on the basis of the detected result of the capacity detection means; and an encoder 4 for compressing the data recorded in the recording medium 7a so as to be a bit rate lower than the bit rate of the data when the decision means decides that it is not.
