A mobile communication terminal having a data processing function by emotion recognition, a base station server, and a method using the terminal and the server are provided to transmit emotional state data according to a user's emotional state to the base station server, thereby receiving contents data in accordance with the user's emotional state from the base station server. The first storage(110) stores voice characteristics in accordance with an emotional state. A voice analyzer(130) extracts a voice characteristic from a user's speech voice. A controller(140) decides whether a voice characteristic identical with the extracted voice characteristic exists in the stored voice characteristics. A data generator(150) generates emotional state data corresponding to the extracted voice characteristic, according to a control signal of the controller(140). A transmitter(160) transmits the generated emotional state data to a base station server. A receiver(170) receives contents data in accordance with the emotional state data received from the base station server.
