A battery management system and a method for determining an SOC(State Of Charge) are provided to correct an SOC by using the SOC reset data for preventing an over-charge by calculating an estimation SOC based on lower charge efficiency than real charge efficiency. A method for determining an SOC includes the steps of: measuring a pack current and a pack voltage of a battery(S100); calculating an estimation SOC based on an equation(S120); determining whether the pack voltage corresponds to a specific reset pack voltage or not(S130); if the pack voltage corresponds to the specific reset pack voltage, outputting a test SOC stored corresponding to the specific reset pack voltage as the current SOC of the battery(S140); and if the pack voltage does not correspond to the specific reset pack voltage, outputting the estimation SOC as the current SOC of the battery(S150).
