<p><P>PROBLEM TO BE SOLVED: To provide an occupant protecting device having occupant protecting performance compatible with comfortableness by bringing waving wind-up timing forward only in case that there is a high possibility of emergency brake operation. <P>SOLUTION: The occupant protecting device constrains an occupant by operating a motor 4 to wind up the waving 2 of a seat belt when a detection value based on the vehicle driving operation exceeds a motor operation threshold value. An ECU (control means) 11 corrects the motor operation threshold value lower, as pedal operation switching time as a time difference between timing to start returning an acceleration pedal 8 and timing to start operating a brake pedal 6 is shorter, on the basis of the detection information of an acceleration pedal sensor 9 and a brake pedal sensor 7.
