An infrared communication apparatus and an infrared communication method for enabling data communication with a receiving apparatus regardless of a protocol that can be supported by the receiving apparatus. There are included a transmitting part (100) that transmits, to a receiving apparatus (2), a first packet for inquiring whether a first protocol can be supported and a second packet for inquiring whether a second protocol can be supported at least once and thereafter transmits thereto a plurality of third packets for inquiring whether a third protocol can be supported; a receiving part (104) that receives, from the receiving apparatus (2) having received the first packet, second packet and plurality of third packets, a response packet indicative of a protocol that can be supported by the receiving apparatus (2); and a data transmitting part (106) that transmits, based on the protocol indicated by the response packet received by the receiving part (104), data to the receiving apparatus (2).
