A device for preventing speech data on the speaker from being packeted into an IP packet and sent to the external network when the speech is buried in the ambient noise. The device comprises a speech data creating section (102) for converting a speech into digital data, an ambient noise estimating section (106) for estimating the ambient noise level from the speech data acquired by the speech data creating section (102), an ambient noise threshold storage holding section (108) for holding a threshold level to serve as a judgment criterion, an ambient noise judging section (107) for comparing the ambient noise level estimated by the ambient noise estimating section (106) with the threshold level, and an IP packet creating section (104) for selectively packeting the speech data into an IP packet if the level of the ambient noise level is judged to be lower than the threshold level by the ambient noise judging section (107). Therefore, if the ambient noise is loud, the speech data on the speaker is not packeted into an IP packet nor transmitted to the external network.
