PROBLEM TO BE SOLVED: To provide an apparatus and method capable of digitally detecting a tracking error signal using multiple phase clocks. SOLUTION: This tracking error detection apparatus includes a phase extracting part, a phase difference detecting part, a multiple phase clock generating part, a phase error detecting part, and a tracking error output part. The phase extracting part extracts four divided phases to the four respective divided outputs which are four-divided and detected and generated in response to the light reflected from an optical disk; the phase difference detecting part detects phase differences between two different phases among the four divided phases; the multiple phase clock generating part generates a plurality of phase clocks in response to a predetermined clock signal; the phase error detecting part counts phase differences in response to each of the plurality of phase clocks, summing up the counted phase differences to detect the sum of the phase error; and the tracking error output part detects the tracking error signal in response to the sum of the phase error and outputs the detected tracking error signal.
