A mobile terminal for controlling the floor of a user and a method thereof are provided to prevent voices or videos around a user from being exposed unintentionally to other users by selectively executing media transmission according to a media data transmission confirm result in case a PoC(Push-to-talk over Cellular) user is given the floor or the right to transmit data, regardless of his/her will, in a PT(Push-to-talk) service. In case the first PT client having a pre-emptive priority requests the floor while the second PT client is transmitting media data with the floor or the right of transmission(S20), the first PT client sends a talk burst request message to a PT server(S21). The PT server requests the second PT client to cancel the floor by using a stop talk burst message(S22). The second PT client, receiving the stop talk burst message, transmits a talk burst complete message to the PT server after transmitting the last media packet(S23,S24). The PT server transmits the last media packet, received from the second PT client, to each PT client. Then, the PT server sends a talk burst confirm message to the first PT client in order to inform the first PT client that the floor has been granted to the first PT client(S25).
