An uplink scheduling system in a communication system and a method thereof are provided to allow all base stations to have appropriate levels of loads through load control, thereby ensuring fairness by detecting channel state changes between each MS(Mobile Station) and the base stations as guaranteeing coverage which satisfies a reference data transfer rate. An uplink scheduler determines an MCS(Modulation and Coding Scheme) level for a connection, which will conduct the current uplink scheduling, as a maximum value assignable according to a load control operation(311), and calculates the number of assignable slots in consideration of both bandwidth requirements of the connection and the number of information data bits to be transmitted(313). The uplink scheduler determines a transmission type in consideration of the bandwidth requirements(315), and checks whether the determined transmission type is different from an existing transmission type(317). If so, the uplink scheduler determines the number of the determined assignable slots as the number of finally assignable slots only when the slots are less than the number of the assignable slots, additionally selects the current connection, and determines the determined transmission type as a transmission type for MSs(319).
