A device and a method for upgrading a mobile terminal are provided to easily upgrade the mobile terminal by making software of the mobile terminal store non-volatile data list information of the mobile terminal requiring the backup, and making a DLL(Dynamic Link Library) file universally transceive upgrade data and read the non-volatile data without respect to a kind of the mobile terminal. A storing part(120) stores a universal DLL file for performing upgrade of the mobile terminal(200), the upgrade data, and backup information. A mobile terminal interface(130) communicates with the mobile terminal. A display part(140) outputs a user interface for an upgrade control command for the mobile terminal and upgrade progress information. An input part(150) inputs a user control command and data for upgrading the mobile terminal. An upgrade controller(110) performs the upgrade of the mobile terminal by using the DLL file according to the user control command. The upgrade data transmitted to the mobile terminal includes the non-volatile data information which is a backup object of the mobile terminal. The universal DLL file is universalized to transceive the data without depending on the kind of the mobile terminal.
