<P>PROBLEM TO BE SOLVED: To provide a light emitting element capable of efficiently injecting light emitted at an emitting part into a luminescent material and suppressing the deterioration of sealing resin when being sealed thereby. <P>SOLUTION: A light emitting element 1 has a n-type semiconductor layer 2 composed of an n-type nitride semiconductor material and a p-type semiconductor layer 3 composed of a p-type nitride semiconductor material, and equipped with a light emitting diode A where electrodes 22 and 23 for injecting currents are laminated respective semiconductor layers 2 and 3, and an insulation layer 4 holding a light emitting part B of the light emitting diode A. An active layer (not shown) composed of a nitride semiconductor material is formed between the n-type semiconductor layer 2 and the p-type semiconductor layer 3. The light emitting part B is made of the p-type semiconductor layer 3, the active layer, and the n-type semiconductor layer 2, and a sapphire substrate which is a substrate for crystal growth is removed from a surface in the thickness direction of the light emitting part B.
