An optical element and an optical module are provided to miniaturize an element and to reduce a cost by not having a sloping glass on a receiver of a sleeve of the optical module. In an optical element(100), an optical detecting element(120) is formed on an emission surface of a flat-luminescence type semiconductor laser(140). The optical detecting element(120) includes a semiconductor layer(122) having a light absorption layer. A thickness of the semiconductor layer(122) satisfies a following equation: (2m-1)lambda/4n-3/16n<d<(2m-1)lambda/4n-3/16n, wherein, an m represents an integer number, an n represents a refractive index of the semiconductor layer, and a lambda represents a design wavelength of the flat-luminescence type semiconductor laser.
