PROBLEM TO BE SOLVED: To provide an acoustic material which has fire retardancy, can effectively absorb a wide band of the noises of not only a low-frequency range of≤200 Hz but also a high-frequency range exceeding 200 Hz and can improve the flexibility of a product form, and to provide a structure using the same. SOLUTION: The acoustic material comprises a resin film 11 composed of an acrylic resin and a porous body layer (a first porous body layer) 12 laminated on a back surface side of the resin film 11. The resin film 11 is formed of, for example, an acrylic resin which has the fire retardancy and does not generate hazardous gas during combustion. The resin, wherein firstly, an oxygen index is≥25, secondly, a combustion calorific value per unit volume is≤8 MJ/m<SP>3</SP>, and thirdly, a combustion heat generation rate is≤([200 kW/m<SP>2</SP>] 10 sec) is preferably used as the resin film 11. The first porous body layer 12 is formed of a material having the fire retardancy, for example, either of glass wool or rock wool or their mixture. The acoustic material 1a of such configuration is installed so that the first porous material layer 12 is directed toward a rigid wall 2 side and so as to be in parallel with the same toward the rigid wall, so that the structure 3a of this invention is formed.
