An FA(Foreign Agent) device having an available packet selecting function and a method thereof are provided to individually set access control lists in an ingress interface and an egress interface of an FA when mobility is managed by using a mobile IPv4(Internet Protocol version 4), thereby preventing a packet of a terminal whose source address is modulated from entering a network. As a packet enters, a source address is checked(401). It is decided whether the source address of the packet is identical with an interface address, and if not, it is checked whether the packet is generated from a registered mobile communication terminal(402,404). If so, the packet is capsulated, and the source address is changed into the interface address(405). If the source address of the packet is the same as the interface address or an IP(Internet Protocol) address of a jurisdictional network, the packet is delivered to the outside(406,407).
