A packet data transmitting device and method in a mobile communication system and a system thereof are provided to carry out a scheduling process in a base station, so as to maximize the number of substantially transmitted valid bits for packet size of a transfer format when multi-user packets are generated and transmitted, thus packing efficiency is magnified. At least one AT(Access Terminal)(510) transmits data rate control information for receiving forward data from an AP(Access Point)(501), to the AP(501). The AP(501) calculates a schedule metric value for determining priority of the AT(510) by receiving the data rate control information to check whether to send data in single user packet or multi-user packet type to the AT(510), and if multi-user packets are generated, the AP(501) generates the multi-user packets by determining multi-user data rate control according to the sum of size of data to be transmitted to the AT(510) which sends compatible data rate control information.
