A surgical instrument having a fluid actuated opposing jaw is provided to perform a minimum invasion surgical operation process by comprising an upper jaw and a lower jaw where an elongate shaft and a handle are located through an insertion tube of a trocar. A handle(22) generates closure operation. An elongate shaft(18) is attached to the handle. An end effector(14) is attached to the end of the elongate shaft, and includes an opposed jaw to clamp tissue. A pair of pivot member contacts with the tissue, and includes a proximally projecting lever. A fluid operation closure mechanism includes a fluid effector located among the lever, a fluid tube linking the fluid effector and the elongate shaft, and a fluid storing part responding to the closure operation by the handle in order to transfer the fluid selectively and bi-directionally.
