PROBLEM TO BE SOLVED: To attain data recording while the real time property is guaranteed in recording data in a disk recording medium. SOLUTION: In a recording and reproducing apparatus 31, an area determination part 121 determines whether an area just after a recording end position which is the final recording position of an optical disk 101 in which data are recorded is a free space or not. When the area just after the recording end position is a free space, a data control part 122 controls a drive 65 to record new data in the free space just after the recording end position, and when the area just after the recording end position is not a free space, searches a free space of a prescribed capacity and more, records the new data in the free space and updates the recording end position stored in a storage part 115 to the final position on the optical disk 101 in which the new data are recorded.
