<p><P>PROBLEM TO BE SOLVED: To prevent congestion and reduction in transmission rate caused by retransmission of data. <P>SOLUTION: A sequence control unit 24 gives sequence numbers to ordinary packets stored in a transmitting buffer 23, in such a manner as continuing the sequence number of the ordinary packet just transmitted previously on the basis of the sequence numbers stored in an ordinary packet information storing unit 25. A transmitting unit 30 selects the ordinary packet or retransmission packet on the basis of the transmission rate, and transmits the selected packet after giving the sequence number to this packet. The ordinary packet information storing unit 25 stores the number given to the ordinary packet to be transmitted by the transmitting unit 30.
