PROBLEM TO BE SOLVED: To provide a forging device and a forging method where, in a forging stage, regarding a stock having burrs such as cutting marks, the marks of the burrs left after its forming can be removed or suppressed without damaging a formed shape in the conventional forging stage. SOLUTION: Regarding the forging device where a punch 2 and a die 3 arranged so as to be confronted movably to relatively approaching/separating directions are provided, and these are made to approach, thus a cutting material 50 set between the punch 2 and the die 3 is compressed to the inside of a forming space composed of the punch 2 and the die 3, so as to be formed into a prescribed shape, a surface area expanding means where, in the stage of making the punch 2 and the die 3 to approach, a part of a compression face 3a forming the forming space is temporarily projected to the inside of the forming space, and the surface area of the stock to be compressively deformed is temporarily expanded is provided.
