An optical recording and reproducing apparatus, an optical head, an optical recording and reproducing method and a skew detection method are provided to precisely detect the inclination between a near-field light irradiating unit and the surface of an optical recording medium. A receiving member(28) divides and detects the returned light from an optical recording medium(10). A control member(29) detects a relative inclination between the optical recording medium and a near-field light irradiating unit by plural gap detecting signals produced from divided detection signals. A driving control member(30) outputs a driving signal for correcting the inclination of the near-field light irradiating unit to a driving member(31) in response to the inclination detected from the control member.
