PROBLEM TO BE SOLVED: To achieve smooth data transmission by decreasing the probability of erroneously determining a "DTX" to be a "Down" command by user equipment UE and transmitting data without decreasing a transmission rate of an uplink even if data transmitted to a transmission buffer are again generated. SOLUTION: The transmission rate control method includes steps of: a Node-B for transmitting a relative rate grant channel to the UE; and the user equipment for bringing a transmission rate to 0kbps by discriminating the reception of the relative rate grant channel including the Down command when no data to be transmitted are left in the transmission buffer and received signals in a relative rate grant channel are consecutively "-1" twice or over.
