A content transmitting apparatus is provided to limit a fair watching or copying of contents within a private right. In a content transmitting apparatus(100), a network communication processing device(103) performs transceiving of data through a network. A transmission content generating device supplies contents to be transmitted to a content receiving apparatus(200) connected through the network to the network communication processing device(103). An authentication device(104) authenticates the content receiving apparatus(200) and transmits information about an exchange key to the content receiving apparatus(200). An encryption device(102) generates key information based on the information about the exchange key and performs an encryption process of the contents to be transmitted to the content receiving apparatus(200) by the key information. A first timer device(107) transmits the information to the content receiving apparatus(200) and measures estimated time until receiving a response to the transmitted information from the content receiving apparatus(200). A device information managing device(108) registers and manages device information and a counter value of the content receiving apparatus(108). A second timer device updates the counter value managed by the device information managing device(108) whenever predetermined time elapses.
