PROBLEM TO BE SOLVED: To provide a base station which can shorten the transmission time of a control signal, and to provide a mobile station, a mobile communication system, and a control information transmission control method.

SOLUTION: The base station includes a means for determining the transmission rate of a control channel for transmitting the control signal of an upper layer, and a means for assigning a predetermined band to the control channel for transmitting the control signal of an upper layer according to a transmission rate thus determined and transmitting the control signal.
