An information recording device (300) is provided with a recording means (301 or the like) for recording second information in a second recording layer (L1 layer) by (i) one laser beam which holds a recording power with which an excellent reproduction quality can be obtained when a first recording layer (L0 layer) transmitting laser beam is in a recorded status, or (iv) by other laser beams which hold a recording power with which the excellent reproduction quality can be obtained when the first recording layer is in an unrecorded status. The information recording device is also provided with formatting means (301, 305 or the like) for formatting a part of the first recording layer into one or other status in a prescribed timing, and a control means (305 or the like) for controlling the recording means to perform recording by the one or other laser beams based on the status of the formatted first recording layer.
