<p><P>PROBLEM TO BE SOLVED: To obtain an occupant restraining device avoiding the operation of an overheat protecting function by stopping sensible warning when a motor is in an overheat state, and certainly restraining an occupant at a critical moment of restraining the occupant. <P>SOLUTION: The occupant restraining device includes a warning means 3 outputting first and second warning signals on the basis of a collision risk with an obstruction in front of a vehicle, a seat belt motor controlling means 4 outputting a control signal so as to wind up a seat belt by first and second motor torque according to the warning signal, a motor 7 winding up the seat belt having an overheat protecting means 8 intercepting the supply of power source when exceeding predetermined temperature, a motor temperature detecting means 9 detecting motor temperature, and a motor overheat determining means 10 making the operation temperature of the overheat protecting means 8 reference, and determining a motor overheat state when the motor temperature exceeds a predetermined threshold value.
