A battery capacity detecting device of a portable terminal and a method thereof are provided to enable a battery temperature detector to perform a battery capacity detecting function as well by using each thermistor with different resistance value variation sections, thereby increasing the efficiency of battery use. A battery supplies power to a portable terminal. The second thermistor(202) outputs a voltage value in accordance with temperature of the battery. A controller(13) operates the temperature of the battery by using the voltage value delivered from the thermistor(202), while sensing capacity of the battery by using the voltage value. Each thermistor including the second thermistor(202) having different resistance values and different resistance value variation sections is added to the battery one to one, so that voltage values distributed by the corresponding thermistors can be outputted to the controller(13) to sense the battery capacity.
