A device for heating and agitating waste asphalt concrete and asphalt concrete and a road construction method thereby are provided to extend the life span of a road by restricting crack or plastic deformation of the road due to lowering of temperature of asphalt concrete and aggregate separation, and to cut down construction cost by recycling waste asphalt concrete. A device for heating and agitating waste asphalt concrete and asphalt concrete comprises an agitator(10) having an input part(11) inputting asphalt concrete transferred or waste asphalt concrete cut from a road, a mixing unit rotated and installed to mix waste asphalt concrete or asphalt concrete and a discharge unit(13) discharging mixed waste asphalt concrete or asphalt concrete, and a heating unit keeping regular temperature by heating waste asphalt concrete or asphalt concrete mixed by the agitator with a thermostat. The heating unit has a couple of heating terminals heating infrared rays by ceramic, a ceramic protection tube combined with the heating terminal and filled with insulation materials, a heating member contained in the ceramic protection tube to connect the heating terminals, and a fixing bracket fastening the ceramic protection tube. The heating unit heats asphalt concrete by high frequency dielectric heating.
