<P>PROBLEM TO BE SOLVED: To use a fixing member having excellent flexing resistance and surface smoothness, and to provide a toner having excellent cleanability, low-temperature fixability, offset resistance and electrostatic charge quantity distribution. <P>SOLUTION: The fixing member whose outermost layer is composed of different fluorine-based resins, and the toner obtained by at least dissolving or dispersing a compound (A) having active hydrogen group, a compound (B) having an area reactable with the compound (A), a colorant, and a release agent, into an organic solvent, by dispersing the solution or dispersion in an aqueous medium. and by reacting a polymer having an area reactable with a compound having the active hydrogen group therewith or while continuing the reaction, then by removing the organic solvent, thereafter by cleaning and drying the mixture, are used.
