<P>PROBLEM TO BE SOLVED: To provide a battery suppressing a drop in discharge capacity even if placed in a over-discharge state. <P>SOLUTION: In this battery, a positive electrode 21 and a negative electrode 22 are laminated with a separator 23 therebetween, wherein the separator 23 is impregnated with an electrolyte. The positive electrode 21 comprises a composite oxide including lithium, manganese, nickel and cobalt; a composite oxide including lithium and at least either nickel or cobalt; a composite oxide including lithium and manganese with spinel structure, or a phosphorus oxide including lithium and iron.
