PROBLEM TO BE SOLVED: To provide a content use controlling and content transmitting method, apparatus and program for preventing unauthorized use of the content even when a receiver on the receiving side is illegally modified or illegally manufactured. SOLUTION: A content use controlling and content transmitting apparatus 3 transmits encryption content in which the content in digital broadcast is encrypted and use control information for controlling use of the encryption content on the receiving side and has an encryption unit 7b which encrypts the content to make it into the encryption content by a scramble key; encryption units 7c and 7d which encrypt related information including at least use control information and the scramble key to make it into encryption related information by a common key; and a multiplexing part 9 which multiplexes the encryption content and the encryption related information to make them into multiplexed encryption content.
