PROBLEM TO BE SOLVED: To provide a toilet seat device capable of detecting the presence of a user by a single human body detecting sensor irrelevant to the opened/closed states of a toilet lid and a toilet seat and to provide a toilet apparatus having the same. SOLUTION: This toilet seat device to be attached to a toilet bowl is provided with a case incorporating a low tank, a case lid provided on the case, a human body detecting sensor unit which has a light projecting part at least having one end upward projecting from the upper end of the case in the side of the front face of the case and emitting a detection infrared ray for detecting the user, and a light receiving part detecting a reflected wave of the detection infrared ray, the toilet seat turnably attached to the lower part in front of the case; and the toilet lid turnably attached to the lower part in front of the case. This toilet seat device is characterized in that the detection infrared ray is substantially not interfered with the toilet seat and the toilet lid with the toilet seat and the toilet lid fully opened.
