PROBLEM TO BE SOLVED: To provide a technology for recording and reproduction of encrypted contents without regardless of the capacity of contents and a free space of a recording medium.

SOLUTION: An information recording and reproducing apparatus for encrypting the contents to convert the contents into the encrypted contents, includes: a video input section 107 for externally receiving the contents; an encryption section 108 for encrypting the contents by using content key and encrypting the content key on the basis of prescribed information to generate an encrypted content key; a content key area 105 for recording the encrypted content key; a communication section 111 for making communication with an external server; and a controller 106 for outputting the content key of the contents to the encryption section 108, outputting the encrypted contents to the external server via the communication section 111, and outputting the encrypted content key to an internal memory 102.
