PROBLEM TO BE SOLVED: To provide a communication device by which a high speed transmission service is provided in consideration of influence on amateur radio wave, and to provide its communication method. SOLUTION: When the frequency of transmission data is in the frequency band of the amateur radio wave, a controller 22 determines whether the amateur radio wave exists or not on the basis of a demodulating signal by a demodulator 20. When it is determined that the amateur radio wave exists, the controller 22 controls a modulator 12 so that the transmission strength of the transmission data becomes not more than a prescribed value. Consequently, data are transmitted with the normal transmission strength when the amateur radio wave does not exist, so that the high speed transmission service can be provided.
