PROBLEM TO BE SOLVED: To increase safety and reliability by preventing the swivel of a working machine not intended by an operator from occurring by controlling a parking brake according to excavating conditions in a parking brake controller of a working machine. SOLUTION: This working machine having a swivel part with a hydraulically driven excavating work device comprises fluid pressure supply sources 2a and 2b, a fluid pressure actuator 4a, a fluid pressure motor 4e, the parking brake 13 braking the fluid motor 4e, a control valve 6a, a first operating means 9a setting the operating amount L1of the fluid pressure actuator 4a, a second operating means 9b setting the operating amount L2of the fluid pressure motor 4e, a load pressure detection means 12 detecting the load pressure PAof the fluid pressure actuator 4a, an excavating state determination means 21 determining an excavating state based on the work amount L1and the load pressure PA, and a control means 22 releasing the braking of the fluid pressure motor 4e when the second operating means 9b is operated or in the excavating state.
