PROBLEM TO BE SOLVED: To realize a modulating device which suppresses increase in circuit scale. SOLUTION: In a comparison portion 58 of a DSV bit control determining portion 31, an accumulation DSV value to a first hypothesis bit insertion bit stream which inserts "0" in an input data stream as a candidate for DSV control bit, and the accumulation DSV value to a 2nd candidate bit insertion bit stream which inserted "1" in an input data stream as an other candidate of the DSV control bit are supplied, respectively. A comparison portion 58 compares the modulus of these two accumulation DSV values, chooses a data stream (the 1st or the 2nd candidate bit insertion bit stream) which has a small accumulation DSV value in modulus, and determines as a DSV control bit the 1st or the 2nd candidate DSV control bit (if it is a 1st candidate bit insertion bit stream, the bit is "0", and if it is a 2nd candidate bit insertion bit stream, the bit is "1"), inserted in the selected data stream.
