PROBLEM TO BE SOLVED: To provide an optical scanner which is low in noise, high in reliable, less in the loss of light quantity and stray light, small in size and low in cost, and to provide a printer using the optical scanner. SOLUTION: The optical scanner is composed of: a light source 11; a photonic crystal optical element 12 of which at least one material out of materials constructing it is a ferroelectric substance; a voltage controlling portion 13 to control the voltage applied to the photonic crystal optical element 12; and a detecting portion 14 to detect an optical scanning position. Also structures with triangle shaped cross-sections are arranged on a light incident face and on a light emission face of the photonic crystal optical element 12 with a period of 1/2 wavelength of the light source or less. These structures are fabricated simultaneously with the step to form the photonic crystal structure, and consequently the lowering of the light quantity and the stray light are suppressed, and further are realized without cost increase.
