<p><P>PROBLEM TO BE SOLVED: To provide a marking method capable of making a ratio operable according to a rate which can be established beforehand in accordance with a user's policy, wherein the ratio is indicative of a proportion occupied by traffic of a conformed packet for each group within a minimum guaranteed bandwidth. <P>SOLUTION: A desired classification condition for classifying into a plurality of groups G<SB>i</SB>(i=1, ..., n) is established beforehand. Desired proportions C<SB>i</SB>(i=1, ..., n) within a restricted bandwidth occupied by traffic of a conformed packet without a non-conformance mark in each group are established. If an input rate avr evaluated during input of a DS network packet does not exceed the restricted bandwidth, a probability for applying the non-conformance mark to the packet is set to 0. Otherwise, a group G<SB>j</SB>to which packet belongs is determined using the classification condition. A minimum distribute bandwidth MinBj within the minimum guaranteed bandwidth to be distributed to the group G<SB>j</SB>is calculated using the proportions C<SB>i</SB>, and the input rate avr<SB>j</SB>of group G<SB>j</SB>is compared with MinB<SB>j</SB>. An OUT<SB>j</SB>will be set to 0 if it is avr<SB>j</SB>≤MinB<SB>j</SB>.
