PROBLEM TO BE SOLVED: To provide a disk recording and reproducing apparatus in which data can be recorded even if unfinalize processing for a disk is not finished when DRAW operation is performed for a disk being rewritable. SOLUTION: A disk recording and reproducing apparatus 1 recording and reproducing different information is constituted of a system controller 11 provided with a CPU11a, a ROM 11b, a RAM 11c, a display part 12, an operation part 13, an image pickup part 14, a recording and reproducing part 15, a MPEG encoder 16, a MPEG decode 17, a buffer memory 18, an AV memory 19, or the like. The apparatus includes such a means that when an already finalized disk is loaded and a recording button is pressed, recording data is recorded temporarily in a memory, while unfinalization processing is started, after unfinalization is finished, data of a memory means is recorded in a disk 2.
